DRAFT — Pending Legal Review
This document is a draft prepared for professional legal review. It reflects how ServiceHubGY currently operates, but has not yet been reviewed or approved by a qualified attorney, and should not be treated as final legal advice or as confirmation of legal compliance.
Terms of Service
Version 1.0 · Effective 2026-09-09
These Terms of Service ("Terms") govern access to and use of ServiceHubGY (the "Platform"), an online marketplace that helps customers in Guyana find independent local service providers.
By creating an account, or by otherwise accessing or using the Platform, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Platform.
A. Introduction and Acceptance
ServiceHubGY operates a marketplace connecting customers who need local services with independent service providers who offer them. These Terms apply to everyone who uses the Platform, including customers, providers, and visitors browsing without an account.
You must accept these Terms and the Privacy Policy to create an account. Providers must additionally accept the Provider Agreement. Where a fee-related step is reached, the Payment / Refund Policy also applies.
The exact legal name and registration details of the entity operating ServiceHubGY are BUSINESS DECISION REQUIRED and will be added once confirmed. Until then, "ServiceHubGY" refers to the operator of the Platform.
B. Accounts
You must provide accurate, current information when registering and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
You may not impersonate another person or entity, misrepresent your affiliation with any person or organization, or create an account for anyone other than yourself.
ServiceHubGY may suspend or restrict an account it reasonably believes was created with false information or is being used to violate these Terms.
C. Customers
As a customer, you may browse approved providers, request quotes, and post service requests. You agree to provide accurate information about the service you need, including a genuine description, location, and timeline.
When a provider submits a quotation, you may review it and, where the Platform's admin-assisted process selects a provider on your behalf or with your input, proceed to be connected with that provider.
The decision to proceed with a specific provider, and the terms of the resulting service arrangement, are yours to make in coordination with ServiceHubGY's admin-assisted process and the selected provider.
D. Providers
Providers participate on the Platform as independent providers of their own services - not as employees, agents, or representatives of ServiceHubGY. See the Provider Agreement for the full independent-status terms, which are incorporated into these Terms for providers.
A provider is responsible for the accuracy of their quotations and for the professional delivery of the services they agree to perform.
A provider remains solely responsible for determining and maintaining any licences, permits, insurance, or other legal or professional requirements applicable to the services they offer. LEGAL REVIEW REQUIRED: the precise allocation of liability for unlicensed or non-compliant work.
E. Marketplace Role
ServiceHubGY facilitates discovery, admin-assisted matching, quotation, and connection between customers and independent providers. ServiceHubGY does not itself perform, supervise the performance of, or guarantee the results of the underlying services listed on the Platform.
ServiceHubGY is an intermediary. It is not a party to the service arrangement between a customer and a provider.
F. Service Agreements
The actual arrangement for services performed - scope, price, timeline, and any warranty - is between the customer and the selected provider. ServiceHubGY's role is to facilitate the connection and to record the platform/connection fee process described in the Payment / Refund Policy.
LEGAL REVIEW REQUIRED: whether and how these Terms should more formally characterize the customer-provider service agreement (e.g., as a separate implied contract, with what default terms if the parties do not otherwise agree).
G. Provider Verification
ServiceHubGY may review information a provider supplies, including identity and contact details, business information, service and service-area information, and qualification or training evidence, as part of its own onboarding and verification process.
Where ServiceHubGY has reviewed qualification evidence a provider supplied and reached a positive determination, the Platform may display this as "Qualification Verified by ServiceHubGY." This means ServiceHubGY reviewed the evidence the provider supplied, according to ServiceHubGY's own process.
Verification by ServiceHubGY, including a "Qualification Verified by ServiceHubGY" or "Identity Verified" indicator, is not a guarantee of a provider's competence, is not a guarantee of future performance or workmanship, is not an institutional endorsement by any training institution named in a provider's profile, and is not a warranty of service quality of any kind.
Where a provider lists a training institution (for example, the Government Technical Institute or the Board of Industrial Training) in connection with a qualification, that institution has not thereby endorsed the provider, guaranteed the provider's competence or work, assumed responsibility for the provider's services, or become a party to any transaction on the Platform, unless a separate written agreement between ServiceHubGY and that institution says otherwise.
H. User Conduct
You agree not to: provide false or misleading information; impersonate another person or entity; engage in fraud; harass, threaten, or abuse another user; attempt to manipulate reviews or ratings; circumvent ServiceHubGY's admin-assisted connection process to avoid platform/connection fees where those legitimately apply; or otherwise abuse or interfere with the Platform's normal operation.
ServiceHubGY may investigate suspected violations and take action, including warning, suspending, or removing an account, consistent with Section K.
I. Reviews
Reviews may only be submitted following a genuine, completed interaction on the Platform between the reviewer and the party being reviewed. Fabricated, incentivized, or otherwise inauthentic reviews are prohibited.
ServiceHubGY may moderate reviews, including hiding a review that appears to violate these Terms, and reviews may be reported for ServiceHubGY's consideration.
J. Disputes and Complaints
ServiceHubGY provides a mechanism for customers and providers to raise a dispute or complaint about a specific task. ServiceHubGY's admin team reviews disputes raised through this mechanism.
Submitting a dispute does not guarantee a particular outcome, a refund, or any specific remedy. LEGAL REVIEW REQUIRED / BUSINESS DECISION REQUIRED: formal dispute-resolution procedures, timeframes, and any binding-resolution or arbitration language, none of which currently exist and none of which should be implied by this section until decided.
K. Suspension and Termination
ServiceHubGY may decline, suspend, or reject a provider application, and may suspend an approved provider's account, at its discretion, including for incomplete verification, suspected misconduct, or violation of these Terms. A provider whose application is rejected, or whose account is suspended, is not thereby removed from the Platform's records - see the Privacy Policy for data-retention treatment.
ServiceHubGY may restrict or terminate any account for serious misconduct, fraud, or repeated violations of these Terms.
LEGAL REVIEW REQUIRED: precise notice requirements, if any, before suspension or termination, and any appeal process beyond ServiceHubGY's existing admin-review workflow.
L. Intellectual Property
The Platform's software, design, branding, and ServiceHubGY-authored content are owned by ServiceHubGY or its licensors. You retain ownership of content you submit (such as your profile description or portfolio images), and grant ServiceHubGY a licence to display it on the Platform for the purpose of operating the marketplace.
LEGAL REVIEW REQUIRED: the precise scope of that licence (e.g., duration, sublicensing, use in marketing materials) has not been finalized.
M. Availability
ServiceHubGY does not guarantee that the Platform will be available on an uninterrupted, timely, secure, or error-free basis. Features, categories, and functionality may change over time.
N. Disclaimers and Limitations of Liability
The Platform is provided on an "as is" and "as available" basis. ServiceHubGY disclaims warranties of any kind regarding the Platform or the services offered by providers through it, to the fullest extent permitted by applicable law.
ServiceHubGY is not responsible for the acts or omissions of customers or providers, including the quality, safety, legality, or timeliness of services performed, or for any loss or damage arising from a service arrangement between a customer and a provider.
LEGAL REVIEW REQUIRED: this section states a conservative, draft position. The precise limitation-of-liability language, any liability caps, and enforceability under Guyanese law all require professional legal review before this Terms document is finalized.
O. Governing Law and Dispute Provisions
LEGAL REVIEW REQUIRED: governing law, jurisdiction, and any dispute-resolution process (including whether disputes between ServiceHubGY and a user are subject to arbitration, mediation, or the courts of Guyana) have not been drafted. No such provision should be assumed to exist until this section is completed following professional legal review.
P. Changes to These Terms
ServiceHubGY may update these Terms from time to time. When a new version becomes active, users who are required to accept these Terms and have not yet accepted the current version will be asked to review and accept it before continuing to use the affected parts of the Platform. Prior accepted versions remain on record.
Q. Contact
BUSINESS DECISION REQUIRED: a confirmed support/contact channel (email address and/or physical address) for legal and policy correspondence has not yet been configured in the application and is not included here to avoid inventing one.
